Terms of Service

Hisaab Kitaab by Synbuzz functions as a digital ledger and financial record-keeping assistant deployed primarily via the WhatsApp business messaging ecosystem. It enables Users to log monetary transactions, track outstanding balances (receivables and payables), and generate automated reminders with their designated contacts. The Service acts strictly as a neutral record-recording utility and is provided on an "as-is" basis for personal or small business bookkeeping purposes.

By utilizing the Platform, you represent and warrant that you are of legal age to form a binding contract in your jurisdiction. To access the Service, you must associate your profile with a valid WhatsApp-enabled mobile number.

You are entirely responsible for maintaining the security of your device and the confidentiality of any authentication measures (including your WhatsApp account and the Hisaab Kitaab by Synbuzz Stealth Vault PIN). The Company expressly excludes any liability for unauthorized access to your ledger records resulting from your failure to secure your device or PIN.

As a User of Hisaab Kitaab by Synbuzz, you agree to the following obligations:

• Data Accuracy: You alone are responsible for the accuracy, legality, and validity of the transaction data you input. The Company does not verify or audit the financial entries you create.
• Lawful Use: You shall not use the Service to facilitate, record, or track transactions related to illegal activities, including but not limited to the sale of regulated narcotics, illegal gambling, counterfeit goods, or money laundering operations.
• Non-Interference: You shall not attempt to reverse-engineer, decompile, or digitally exploit the Platform's codebase, nor shall you utilize automated scripts, spiders, or scrapers to extract data from the Service.
• Compliance: You are solely responsible for ensuring that your use of the Service complies with all local, state, and national laws applicable to your personal or business financial reporting.

The operation of Hisaab Kitaab by Synbuzz relies fundamentally on third-party infrastructure, specifically the Meta/WhatsApp Business API. Your use of our Service is inherently subject to the availability and terms of these third-party operators.

By using the Service, you grant us permission to send you automated and manual transactional messages, reminders, and service updates via WhatsApp. Furthermore, when you add a contact to a transaction, you represent that you have the authority to share their contact details with the Platform for the purpose of ledger reconciliation.

The Platform may offer integrations with third-party services, such as Google Contacts, to enhance your experience. If you choose to authorize these integrations, you agree that we may access and process the data provided by those services in accordance with your explicit instructions.

Specifically, Hisaab Kitaab by Synbuzz's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

You retain full ownership rights over the specific transaction data you input into the Platform. However, by using the Service, you grant the Company a worldwide, royalty-free, non-exclusive license to host, store, process, and transmit this data solely for the purpose of operating and improving the Service. Our access to and utilization of your data is strictly governed by our Privacy Policy, which is incorporated by reference into these Terms.

No Professional Advice: The Service is an organizational tool, not a substitute for certified financial, legal, or tax professionals. We do not provide accounting advice, nor do our ledgers constitute official tax documents.

"As-Is" Provision: The Service is provided without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, bug-free, or entirely impenetrable to advanced cyber threats.

Liability Cap: To the maximum extent permitted by applicable law, Synbuzz Technologies Private Limited, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, data corruption, or business interruption arising out of your use of the Service. In no event shall our total liability exceed the amounts you have paid to us for the Service in the preceding twelve months.

You agree to indemnify, defend, and hold harmless the Company and its respective officers, agents, and employees from any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with your violation of these Terms or your use of the Service for fraudulent or illegal purposes.

Modifications: We reserve the right to amend, suspend, or discontinue the Service, or modify these Terms at our sole discretion. Any changes will be published on the Platform. Continued utilization of the Service following such publication constitutes binding acceptance of the revised Terms.

Termination: We may suspend or terminate your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any legal disputes, controversies, or claims arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Nagpur, Maharashtra.
